Punjab HC on fake government job racket cases courtroom decision

The Punjab and Haryana High Court has taken a strong stand on fake job rackets. Justice Sumeet Goel said these scams, where people are lured with false promises of government jobs, amount to cheating and must face strict judicial scrutiny. He warned that pre-trial leniency would only encourage such frauds.

In this case, the FIR said the accused took money from a complainant by promising a job for his son. Investigators found that the accused arranged fake medical tests, uniforms, and ID cards. These acts, the court noted, showed a clear intent to cheat. Justice Goel rejected the claim that the case was a civil dispute.

The judge stressed that Section 420 IPC applies when deception and dishonest inducement form the base of a transaction. At the anticipatory bail stage, courts need only check if a prima facie case exists. Minor details like payment dates can be tested at trial, but they do not reduce the seriousness now.

Calling the offence grave and harmful to society, the court denied anticipatory bail. It ruled that strict judicial action was needed to prevent such rackets from growing further.
